No one can foresee the future, but the lawyers we are in contact with tell us that they believe it is highly probable that a case will advance to the US Supreme Court either this year or in 2026, and the resulting SCOTUS decision will lead to the overturn of Obergefell v. Hodges. And at that point the issue of LGBTQ+ marriage equality will be returned to the individual states.
What will happen next? Specifics remain hard to pin down, b/c of various dynamic factors at play at the federal, state and local levels. We urge couples to take steps to protect your relationship through legal documentation, as well as the relationships within your family (specifically if you have children under age 18): Review your powers of attorney, wills, and other important documents. If possible, be sure your passports are up-to-date.
And most of all, find a lawyer who is experienced in LGBTQ+ matters and seek their professional advice.
